ARMED CITIZEN EXCHANGES GUNFIRE WITH ROBBERS, SEVERAL INNOCENT BYSTANDERS SHOT, ONE KILLED

Victim's wife sues San Antonio shopping mall over signs prohibiting guns

SAN ANTONIO - Chilling video released for the first time shows an armed robbery and shootout inside a San Antonio shopping mall in 2017. A good Samaritan exchanged gunfire with the robbers and several bystanders were shot.

One mall customer was killed in that shooting and now his wife is suing Rolling Oaks Mall. The lawsuit alleges the mall failed to post signs at all entrances saying guns were not allowed. Attorneys claim if they had, a good Samaritan never would have brought his inside, and never would have tried to stop the robbery.

In the security camera video, Jonathan and Aimee Murphy can be seen looking at watches while having a wedding ring cleaned at a jewelry store inside the mall.

Two armed robbers then rush into the store. One robber smashes the jewelry case and begins stealing items while the second robber points a weapon at employees.

Another mall customer named Ryan Brockett then intervenes and begins shooting at the robbers, who fire back as they run off.

In the exchange of gunfire Jonathan Murphy was shot by one of the robbers.

"John was a good man, he would do anything for other people," said the victim’s aunt, Sara Nunnelee, when News 4 interviewed her shortly after the shooting in 2017.

Both robbers are now in prison. Attorneys for Aimee Murphy reached a settlement with the good Samaritan Ryan Brockett, whom they claim never saw signs prohibiting handguns in the mall, because they weren't displayed at all entrances.

“There's no way for the person walking into the mall to know they have the no-gun policy unless they actually stumble upon one of these signs that they've testified to that they don't really prominently display," said Stanley Bernstein, an attorney for Aimee Murphy.

News 4 contacted the company that owns Rolling Oaks Mall for comment but they have yet to respond. 

EDITOR'S NOTE: This was not a mass shooting.  The robbers did not resort to gunfire until after they were shot at.  In my opinion, this is clearly a case where an armed citizen should have kept his gun holstered.  By opening fire on the robbers, he should have known he was endangering the mall shoppers. And he didn't even hit any of the robbers.

Armed citizens sometimes think they are functionally cops. They aren't. And shouldn't be.
