A young boy accused of pinning down a 12-year-old girl and stuffing rocks into her mouth while his friends gang-raped her pleaded with a judge to be freed from jail despite a prior run-in with the law.  

Police say Jusiah Jones, 12, held the alleged victim down as his friend Nelson Nunez, 13, sexually assaulted her in a community garden in Miami, Florida.

 Xavier Tyson, who was 14 at the time of the June 18 attack, is alleged to have helped Jones restrain the girl.

She begged the boys to stop, but they allegedly continued the horrific assault for nearly 30 minutes, only stopping after they heard her father calling out her name, police said.

All three boys have been charged as adults and Jones and Nunez appeared in court on Wednesday for an Arthur hearing, which allows judges to consider setting bonds for defendants charged with crimes that aren't normally eligible for bail, the Miami Herald reported.

At the hearing, Jones' mother, Tecola Williams, revealed that her son had been receiving mentorship from the Circle of Brotherhood, an organization of mostly black men dedicated to addressing community problems.

Jones has been involved with the group since he was released from juvenile detention last year after an arrest where the charges were dropped, according to his mother.

'He stayed out of trouble,' Williams said.

It is unclear what Jones had been arrested for and how long he had been in juvenile detention.

Earnest Hardy, a mentor with the Circle of Brotherhood, said that he was shocked by the gang-rape allegations.

'Ever since I met this kid, it was surprising that he is in this situation,' said Hardy. 'He's too young to be in there. There is no rehabilitation.'

Nunez and Jones have pleaded not guilty to the charges and, at Wednesday's hearing, Jones's lawyer implied Nunez was the mastermind behind the crime.

'[Jones] was the only one of the boys who actually took pause and had a conscious and said, "We should stop. This is going too far. This is rape. We shouldn't be doing this,"' the lawyer said.

All three boys have been charged with rape, kidnapping and false imprisonment and are being tried as adults. 

Tyson, now 15, also faces sexual battery charges. His case has been reset and was transferred to another judge.

Witnesses allege that Tyson fondled the girl's breasts as he helped Jones hold her down, the police report said. 

Nunez reportedly asked the boys: 'You think I should put it in?' before he raped the victim. 

The girl could be heard yelling 'no, no, stop, stop, it hurts' while he assaulted her, witnesses told police.

A fourth boy who witnessed the assault but has not been charged with a crime, told police he 'did not intervene because he was outnumbered and was afraid of getting beat up,' the arrest report stated.

The victim's mother, in an interview with WPLG, said she is seeking justice for her daughter but fears there is no punishment that will make this better.

'I'm upset. I'm angry,' the mother said. 'I don't care if they get ten, 20, 30, 40, 50 years, 100 years, guess what, I'm gonna always feel like as a mother, as a woman, I'm gonna always feel like it's not enough.'

The Daily Mail contacted the Circle of Brotherhood for comment.
