DNA clears man who served 37 years in prison for 1983 murder and rape

A Florida man who served 37 years behind bars walked out of prison
one day after prosecutors said DNA evidence exonerated him in a 1983
murder and rape of a woman in Tampa.
Robert Duboise, 55, was released Thursday from the Hardee
Correctional Institution in Bowling Green, where his mother, sister and
an attorney greeted him as a free man for the first time in nearly four
decades, the Tampa Bay Times reports.
“It’s an overwhelming sense of relief,” Duboise told reporters,
adding that he wasn’t angry for being wrongfully convicted in the case
that relied on bite-mark evidence and a jailhouse informant. “I don’t
have room in my life for bitterness. If you keep hatred and bitterness
in your heart, it just steals your joy from everything else.”
Duboise, who was originally sentenced to death, saw his sentence
later reduced to life in prison following an appeal. He was convicted in
the 1983 murder and rape of Barbara Grams, 19, who was attacked as she
walked home from her job at a Tampa mall, the newspaper reports.
The Innocence Project picked up Duboise’s case in 2018 and notified
the Hillsborough State Attorney’s Conviction Review Unit. Teresa Hall,
the attorney who heads the department, told a judge Wednesday old DNA
samples from a rape kit did not match Duboise, clearing the way for his
Thursday release.
Without a legal basis for keeping Duboise incarcerated, Judge
Christopher Nash ordered he be set free and amended his life sentence to
time already served. A Sept. 14 hearing has been set to overturn his
conviction, the newspaper reports.
Duboise learned Wednesday that he would soon be set free, but he had doubts, he said.
”After all these years, you always have to wonder if they’re going to
throw another curve in there somewhere,” he told reporters.
Recent tests of the DNA samples from the rape kit in the case did
include DNA from two other men, including one who is now a person of
interest in the 1983 slaying, Hillsborough State Attorney Andrew Warren
said.
“I hope God has mercy on his soul,” Duboise said. “I’m not his judge.”

It was in Khartoum that the Arab League famously declared, following
the Six-Day War, "no peace with Israel, no recognition of Israel, no
negotiations with it."
There was another condition: no to relinquishing the rights of the Palestinians. And here we are in 2020, and that very Khartoum now all but recognizes Israel, it is willing to talk to it (it's interim leader met with Prime Minister Benjamin Netanyahu several months ago) and it is engaging Israel despite a Palestinian-Israeli peace accord not being any closer.
The historic shifting of sands can be attributed to a whole host of reasons but chiefly among them is the Trump Doctrine.
During the eight years of the previous administration, then-President Barack Obama was eager to appease the worst regimes. He fueled the Iranians with billions of dollars and gave the ayatollahs legitimacy; he embraced Recep Tayyip Erdogan in Turkey, and pro-Islamic Egyptian President Mohamed Morsi, who was briefly in power, as well as the leaders of the Muslim Brotherhood.
He also took the Holocaust-denier and terrorist-funder Palestinian Authority President Mahmoud Abbas under his wings. The result was chaos: The moderate regimes collapsed, the Islamic State terrorist group grew, the Iranian evil powers thrived, and the Palestinian Authority became moribund.
President Donald Trump turned this approach on its head. He has crippled Iran, hit Erdogan hard, and has insisted that the PA get its act together. He also had no qualms about traveling directly from Riyadh to Jerusalem, in what is an unmistakable message. And finally, Trump published the most realistic plan ever on a peace deal between the Palestinians and Israelis.
This peace plan did away with the 1967 borders and no longer automatically accepted the Palestinians' demands. It also agreed that Israel could extend its sovereignty to areas in Judea and Samaria even before a peace deal. So why has this plan, out of all other plans, drawn the Arabs closer to Israel?
Perhaps because Trump and his peace team have refused to let the propaganda and deceit dictate their moves. Reality, truth and loyalty to allies – chiefly among them Israel – are the values that have guided them. This is how you make history, and in the coming days we will likely hear history being made again.

This week the first official flight from
Israel to Sudan took place, with US Secretary of State Mike Pompeo on
board. He probably had a good reason to travel all the way there. The
African country, no longer under the rule of a brutal oppressor, has
been trying very hard to find its path forward despite its many
challenges.
Apart from abolishing Sharia Law and
announcing an election that would take place in two years, the
provisional council that has been governing the country wants to closer
ties with the US and Israel. If and when Jerusalem and Khartoum announce
a peace deal – US officials believe this could be very soon – it will
encapsulate the entire region's history for the past 53 years.

We lucked out with Laura ... but what if we hadn't?
If Galveston and Houston had taken a direct hit from Laura, many thousands of homes and business would have been damaged or destroyed and hundreds of lives would have been lost.
Sooner or later, a catastrophic hurricane on a scale of Laura is bound to make a direct hit on Houston and Galveston.
It's time to revisit Ike Dike!
The Ike Dike was proposed by Professor Bill Merrell of Texas A&M University at Galveston in the aftermath of 2008's Hurricane Ike.
Merrell's proposal was designed to protect Galveston beyond its seawall and to protect the Bolivar Peninsula, the Galveston Bay area and Houston from hurricane storm surges by extending the Galveston Seawall and constructing flood gates similar to those used in the Netherlands. The cost of the Ike Dike was, at the time, estimated to be $4 billion.
Eco-nuts immediately objected to the Ike Dike. They squealed like stuck pigs over the thought that the flood gates would interfere with the migration of marine life despite the fact that the gates would be shut only during a storm. The Eco-nuts made the ridiculous assertion that a natural barrier of sand dunes would work better than Dr. Merrell's Ike Dike.
Next, Rice University threw a monkey wrench into Merrell's proposal by recommending the construction of a flood gate across the Houston ship channel in place of the Ike Dike so as to protect Houston's enormous petrochemical industry. I am not a hydraulic engineer, but it would seem like a flood gate across the ship channel would push a strong storm surge backwards to the sides of the channel, thereby destroying countless homes.
Of course, the biggest objection to the Ike Dike was its estimated cost of $4 billion. Never mind that the Army Corps of Engineers spent $14 billion after 2005's Hurricane Katrina to upgrade New Orleans' flood control system.
In 2020, Texas Governor Rick Perry came out in favor of the Ike Dike and created the Governor's Commission on Disaster Recovery and Renewal to examine regional approaches to storm surge suppression and to secure the same degree of funding from the federal government that was awarded to Louisiana after Hurricane Katrina. A public corporation for Harris, Galveston, Chambers, Brazoria, Orange and Jefferson counties was established for that purpose. But nothing other than some jawing has come from that corporation.
Some of you may recall that in 2017 I wrote an article for Big Jolly Times in which I pushed for the construction of the Ike Dike (Will the Houston-Galveston Area Ever Get the Protection of the Ike Dike? June 29, 2017).
Greg Degeyter made several outstanding comments, including one questioning my notion that a flood gate across the ship channel would cause more flooding of homes.
Almost all the other comments were in opposition to the Ike Dike, either because people should not have built homes in flood prone areas, so fuck 'em,, or the government should not be spending money it does not have.
As for homes in flood prone areas, I don't have any sympathy for people who have built beach-front houses. But without any protection, a strong storm surge would damage or destroy thousands of homes in Houston which are not in flood prone areas and which are not near any beaches.
As for the government spending money it doesn't have, it's been doing that for as long as I can remember. The government has been funding the military, congress, the executive branch, the justice syatem, the health and education departments, etc., etc. with money it doesn't have.
And public safety is one of the most important responsibilities of government. That's why we have the police and prisons. Protecting people from a storm surge is a public safety issue.
We dodged a bullet this time. We might not be as lucky with the next Gulf hurricane. It's not too late to build the Ike Dike. If the government can spend $14 billion to protect New Orleans with fewer than 400,000 people, it ought to spend even twice as much to protect the Houston-Galveston area which has a population of several million people.
The Ike Dike is a great idea. It has the potential of saving property worth far more than the cost to build it. And it will save many lives. We should demand that it be constructed without anymore never-ending studies.

GOOD, BUT SOMEWHAT TOO LONG
President Trump's acceptance speech was good, but Ivanka's introduction was better

I watched last night's acceptance speech by President Trump. It was good but somewhat too long.
I wish he had mentioned that since day one he had been the victim of daily smears by the media and attempts by the Democrats to remove him from office or destroy his presidency.
I think the speech could have used fewer thank yous.
Since I did not watch Biden's speech, I cannot compare the two.
I thought Ivanka's introduction was better than her father's speech.

NANCY PELOSI HEARD FROM ON THE SUBJECT OF DEBATES

Nancy Pelosi opined that Joe Biden should back out of the debates
because President Trump refused to comport himself properly.

I THINK I HAVE IT FIGURED OUT

paying modest attention to both major political parties conventions and
watching the bullshit and bombast connected thereto, as well as various
news broadcasts and reading some actual news papers, I have come to the
following conclusions.
The
Republican Party position: Things were going along pretty good until
the Covid-19 bug hit. (Pretty much true.) Our response to the Covid-19
bug was maybe not perfect but was pretty reasonable and was a damn
sight better than what the Democrats were pushing. (Also pretty much
true.) We have a fair chance of having a vaccine and an effective
treatment both by the end of this year, and a good chance having them by
the spring of next year. (True.) Once we beat the Covid-19 bug we
will be back in very good shape. (Probably true.)
The
Democrat Party position. We hate Donald Trump. (Undeniably true.)
Donald Trump is a nasty, incompetent bastard. (Probably not true.) We
will make sure all this violence and bullshit keeps happening unless you
vote us in, and maybe even beyond then. (Almost certainly true. It is
a basic shakedown operation. It may work.)
That's
basically it. The Democrat-Socialist are trying to extort us to vote
for them by threatening to burn down out businesses, chase us out of
restaurants and have loud, irritating "demonstrations" on our front
lawns all night unless we vote for them. The Republicans are saying,
"Fuck this shit, arrest those assholes."
You have not quite ten weeks to make up your mind which position appeals to you. Choose wisely. .
THE PERILS OF LIVING IN THE MIDDLE OF NOWHERE

Jim
and Norma Gund live in the middle of nowhere in Trinity County, CA.
Nine years ago they were contact by a Sheriff's Corporal, Ron Whitman,
and asked to do a welfare check on their neighbor, who had made a 911
hangup call.
When they got
there they were attacked by a man armed with a knife and a Taser. He
damn near killed them. They believe they were entitled to some sort of
compensation as they were working as agents for the S. O. at the time.
Yesterday
the California State Supreme Court told them they were ass-out. (They
did get workers comp for the actual injuries.) Apparently there is an
obscure section of state employment law that states specifically that
law enforcement volunteers can't sue an agency for damages under any
circumstances.
The deputy neglected to mention the neighbor, Kristine Constantino, whispered "Help.....help" before the phone went dead.
Ms.
Constantino and her boyfriend, Christopher Richardson, were dead in the
house when the Gunds arrived. Their killer, Thomas Gouverner, nailed
Norma Gund with the Taser then cut her throat as soon as she entered the
house. When her husband Jim entered the house to see what the problem
was he was also attacked. He managed to fight Richardson off and fled.
At the end of a 40 mile chase a tree jumped out in front of
Richardson. The crash killed him.

THEY AREN'T INTENDED TO BE FREAKING PETS

Mathewson, 68, was a well-known conservationist in South Africa until a
couple of days ago. He kept two white lions at his safari lodge. On
Wednesday he let them out of their enclosure for their morning walk with
him and the two adult females attacked and killed him.
Three years ago they broke out of their enclosure and killed a man on a neighboring property.
The animals were rescued from a hunting farm as cubs.
The 400 pound animals were tranked and relocated. They will be released into the wild sometime along the line.

In a video posted to Twitter Monday, Christian Walker said the shooting of Blake in Kenosha was 'another incident of a crazy violent criminal refusing to follow directions from police officers and getting consequences for it.'
Blake, 29, who was unarmed, has been left paralyzed from the shooting. He was reportedly involved in a physical altercation with police before walking to his vehicle when an officer opened fire from behind.
'Jacob Blake, oh yeah he was a felon sexual assaulter, he was a domestic abuser and had given cops trouble in the past. There was a warrant out for his arrest,' Christian said in the clip.

The tweets were allegedly posted by Alisa Blair and Tiffany Townend Blacknell, two members of Gascon’s Public Policy Committee.
Tweets posted by the accounts belonging to Blair and Blacknell are under the microscope. On May 29, during the civil unrest after the killing of George Floyd, Blair posted a tweet that said “Burn that sh*t down. We must destroy in order to rebuild.” On June 5th, in response to a video of LAPD engaged with protesters in LA’s Fairfax District, Blacknell’s Twitter account posted “Look at these barbarians! #LAPD is an occupying army! #DefundPolice.”
“I was stunned,” L.A. County D.A. Jackie Lacey told FOX 11. “You shouldn’t have anybody on your committee whose talking about burn it down, when the city is burning because of rioting and looting. The other tweet, abolish prisons? So where do rapists go? Where are people who murder going? Are these people going to form the public safety policy for the LA County DA’s office? They shouldn’t!”

As reported by the Twitter account of the BDS Report, individuals are shown marching through the streets of NYC waving Palestinian flags and yes, Hezbollah flags. Let me be clear: Any individual or American who supports Hezbollah has no business being an American or living in this country. Hezbollah is a terrorist organization that has murdered hundreds of Americans.
Hezbollah is an Iranian Regime proxy in Lebanon and a Foreign Terrorist Organization as designated by the US Department of State. They have also been labeled as a Terrorist Organization by Canada, Germany, United Kingdom, Argentina, Honduras, and the Gulf Cooperation Council (Saudi Arabia, United Arab Emirates, Bahrain, and Kuwait). They are directly and indirectly responsible for the savage murders of Americans, Christians, and Jews around the world.
Here is a quick primer on Hezbollah;
Hezbollah was founded in 1982 by Iran's Revolutionary Guards as a Shiite Islamist political party and militant group based in Lebanon. They are the most powerful terrorist group in Lebanon due to their heavily armed militia. Much of these arms and the training that came with these arms points directly to the Iranian regime. Hezbollah is both a political movement and a fully functioning army.
It's been estimated by US Officials that Hezbollah receives as much as $700 Million per year from the Iranian regime. Midler, 74, made the remarks as the first lady was delivering her Republican National Convention speech from the Rose Garden.

I have trouble understanding the validity of this concept. The people
that own and work at the car dealership that was destroyed didn't have a
damn thing to do with Jacob Blake getting shot. The two people who
were murdered Tuesday night in Kenosha probably didn't have a damn thing
to do with it either. Somehow doing this sort of thing is, I suspect,
not really helpful to the cause, whatever the fuck that cause may be.
Unless of course the real cause is social unrest with the intent to

A 17-year-old has been arrested over a shooting in Kenosha, Wisconsin
last night that left two protesters dead and another injured in a
possible vigilante attack amid a wave of looting. Kyle Rittenhouse was
arrested on Wednesday afternoon in his hometown of Antioch, Illinois and
charged with first degree intentional homicide.
The teenager's arrest came hours after video footage emerged showing
Rittenhouse walking up to police with his hands in the air and his
semi-automatic rifle slung across his body just moments after the
shooting. He was apparently allowed to walk by despite members of the
crowd yelling for him to be arrested.

appeared to show the teen guarding a local car shop with a group of
armed militia members. Another video showed police thanking an armed
group, of which the teenager appeared to be part of, and offered them
water.

One of the speakers for the second night of the Republican National Convention was pulled from the program after The Daily Beast surfaced a tweet from her, earlier in the day, urging her followers to investigate a supposed Jewish plot to enslave the world.
“Do yourself a favor and read this thread,” Mary Ann Mendoza, who is a member of the Trump campaign’s advisory board, tweeted to her more than 40,000 followers Tuesday morning.
Mendoza, an “angel mom,” was scheduled to speak Tuesday about her son’s 2014 death at the hands of a drunk driver who was in the country illegally. But a Republican source familiar with the programming said the speech had been cancelled amid uproar over her tweet.
Hours earlier, Mendoza had linked to a lengthy thread from a QAnon conspiracy theorist that laid out a fevered, anti-Semitic view of the world. In its telling, the Rothschilds—a famous Jewish banking family from Germany—created a plot to terrorize non-Jewish “goyim,” with purported details of their scheme that included plans to “make the goyim destroy each other” and “rob the goyim of their landed properties.”
Drawing on more than a century’s worth of anti-Semitic hoaxes and smears, the thread claimed that malevolent Jewish forces in the banking industry are out to enslave non-Jews and promote world wars. Riddled with QAnon references, the thread from Twitter user @WarNuse claimed that the Titanic had been sunk to protect the Federal Reserve, and that every president between John F. Kennedy and Donald Trump was a “slave president” in the thrall of a global cabal.
The thread also promoted “The Protocols of the Elders of Zion,” an anti-Semitic hoax popular in Nazi Germany, and claimed that its allegations about a Jewish plot to control the world are real.
“The Protocols of the Elders of Zion is not a fabrication,” the thread that Mendoza shared reads. “And, it certainly is not anti-semetic (sic) to point out this fact.”
After The Daily Beast published this article, Mendoza deleted her tweet and tweeted an apology “for not paying attention to the intent of the whole message.” While Mendoza had initially urged her followers to read the thread, she claimed on Tuesday evening that she had not read all of the posts in the thread.

A large crowd of Black Lives Matter protesters have accosted white diners outside several Washington, D.C. restaurants, demanding that they raise their fists to show solidarity with the movement.
Footage showing the demonstrators aggressively yelling at one woman in the Adams Morgan neighborhood went viral on social media and sparked a widespread backlash. Many accused the protesters of acting like an 'aggressive mob' and using 'intimidation tactics' to order to diners into submission.
Responding to the footage, MSNBC host Joe Scarborough described the activists as 'horrible people'.

Teachers shot by plastic pellets during training drill sue sheriff's department, officers

Eight elementary school teachers who were shot with airsoft guns “execution style” during an active shooter training drill last year are suing the sheriff’s department that conducted the training.
The controversial training drill, conducted at Meadowlawn Elementary School in Northern Indiana last year,
became national news after teachers reported being left bruised,
bloodied and traumatized. The lawsuit, filed last week in Indiana’s
northern federal court, claims that four White County Sheriff’s Deputies
subjected teachers “verbal threats, expletives, and screaming,” in
addition to being struck with the plastic pellets fired from airsoft
guns.
“The teachers displayed obvious signs of
anguish and physical pain, but were humiliated to find the law
enforcement officers joking and laughing at them,” the complaint reads.
“The terrifying and inexplicable experience left the teachers with
lasting physical and emotional injuries.”
Two of the teachers named in the complaint said they left teaching after
the incident, which took place last January but didn’t gain national
attention until several months later when the Indiana State Teachers
Association testified about it in an Indiana General Assembly committee
meeting. A first-grade teacher was diagnosed with PTSD.
The White County Sheriff’s Department did not
respond to a request for comment. Sheriff Bill Brooks, who is among the
officers named in the complaint, told IndyStar after the incident last
year that the department stopped using the airsoft guns after a
complaint.
"We were made aware that one teacher was upset," he said in a phone interview last March. “And we ended it."
The lawyers representing the teachers did not
respond to a request for comment. They are also represented by ISTA,
which said it hopes to prevent similar incidents in the future.
Bruises, welts and abrasions
Teachers
at Meadowlawn Elementary School were supposed to be receiving what is
called ALICE training, an "options-based" approach that encourages
students and teachers to be proactive in their response to an active
shooter and teaches tactics that include rushing a shooter in some
situations.
Thousands of schools across the country, including
many in Indiana, use ALICE. Shooting teachers with plastic pellets is
not typically part of the training.
Eight
teachers, out of approximately 35 that were present for the Meadowlawn
training, have signed on to the lawsuit, each with claims of being left
with bruises, welts and abrasions from being shot with the airsoft guns
from “point-blank range.”
According to the
complaint, the teachers were broken up in small groups and told by
sheriff’s deputies to line up facing a wall and kneel. Once they were
kneeling, an officer shot the teachers across their backs.
They were told not to tell the other teachers, waiting in another room for their turn, what had happened.
Later
in the day, teachers were also subject to a series of drills in which
they were instructed at different times to hide in classrooms, to try
and barricade doors from potential intruders and to throw tennis balls
at the officers. During each drill, officers shot the teachers with the
airsoft guns, according to the complaint.
According to the complaint, each of those drills
began with an officer “striding quickly down the hallway, loudly banging
on walls while screaming furiously, yelling out numerous obscenities
and threats, such as… ‘I’m going to kill you all!’”

Physical and emotional injuries
The
complaint says that each teacher was left with injuries that took
anywhere from several days to several weeks to heal. One first-grade
teacher was left with a permanent scar.
The injuries recorded weren’t only physical. According to the complaint, the teachers experienced “several emotional distress.”
One
fifth-grade teacher said she now experiences greater fear and anxiety
while doing her job, according to the complaint. Others report losing
their faith and trust in law enforcement officers. Two sought
psychiatric help.
The lawsuit claims officers used excessive force,
committed assault and battery, intentionally inflicted emotional
distress and subjected teachers to unreasonable seizure and false
imprisonment. They are seeking compensatory and punitive damages.
The
Indiana State Teachers Association, which represents the involved
teachers, said it wants to prevent other teachers from going through a
similar incident.
“We do not believe that a
school or trainer should conduct any kind of active shooter training
drill,” said Keith Gambill, ISTA president, "that includes the firing of
any type of projectile at an employee or a student."
During the hearing last March, ISTA had been asking lawmakers to
prohibit such trainings in schools but the language was removed before
the bill it was added to was passed. Gambill said the organization will
continue to seek legislative help to prohibit these types of trainings
and increase mental health support for students.
