The state of Delaware just passed a bill requiring that,
in order to BUY a gun, you must be fingerprinted, undergo training and
then receive specific permission from the government. The vote was
strictly party-line. The Governor, John Carney, has not yet signed it
but has said he would when it got to his desk.
The vote came one week after the old Delaware permit-to-purchase law was declared to be unconstitutional.
Such
a permit would be valid for two years. It can be revoked
administratively, and any guns purchased on the permit seized without
further review, if the director of the State Bureau of Identification
determines that the permit holder is a danger to himself or others. It
isn't real clear what criteria, if any, the director may use to make
that determination. Active and retired law enforcement officers are
exempt as are carry permit holders.
The program is budgeted at $2.9 billion for the coming fiscal year.
The bill will certainly attract court action and will, IMHO, be determined to be clearly unconstitutional as well as stupid.
