In a ruling issued Friday a
three-judge panel of the Ninth Circuit Court of Appeals, by a 2-1 vote,
struck down the laws that effectively ban the open carry of firearms in
about 85% of the state. The majority opinion, written by Lawrence
VanDyke, asserted that the matter wasn't even close seeing as how open
carry was NOT banned early in the U. S. history. The current law bans
open carry in all counties with more than 200,000 people, which is
almost all of California.
It
is very likely that this matter. Baird v. Bonta, will be revisited by
SCOTUS which is already supposed to look at two other 2A cases this year
including a case out of Hawaii, which has some of the most restricted
carry laws in the nation.
