While I have repeatedly said that Hillary Clinton will not be indicted over her private email sever under an Obama administration, I have nevertheless kept sticking my head in the clouds hoping that she will somehow be indicted.
It’s time for me to keep my head out of the clouds. Hillary probably would not be indicted under a Trump administration. How come? Because in order for Hillary to be indicted, prosecuted and convicted, the government would have to show that the Hildebeast acted with criminal intent.
Sending and receiving State Department communications over a private email server may well be against the department’s rules, but that does not make it a crime. Prior Secretaries of State have done so themselves.
Clinton’s use of her private email server was stupid and she was careless and sloppy while conveying State Department communications, some of which may have been top secret. Stupidity, carelessness and sloppiness are not crimes either.
So, unless the government can show the Hildebeast acted with criminal intent by deliberately mishandling State Department secrets, or lied to the FBI or Congress, there has been no crime committed and thus there are no grounds to indict Hillary.
It was Monday that I pulled my head out of the clouds. On Tuesday, FBI Director James Comey recommended no prosecution of Clinton. He explained that although Hillary was “extremely careless” in the use of her private email server, there is no evidence that she intentionally mishandled classified information. Comey said, “No reasonable prosecutor” would bring such a case.
Weep and wail if you will, but the Clinton email server case is closed, period!

I am fully confident that the fix was in. The day before the announcement, when Hillary flew with Barry to a campaign function, I knew it. I admit I HOPED she would get nailed, but I didn't really expect it, even though she was clearly guilty as shit. Barry announcing in public repeatedly that Hillary was clearly not guilty and Lynch meeting with Bill in private were pretty strong clues. The only real question was how they got the Comey and Lynch. Was it an outright bribe, in-your-face pressure or something more subtle, like high-paying future jobs with the Clinton Family Slush Fund? One thing for sure, Trump is right in one respect. The system is crooked and the crooks are running it.
Sorry Bob, but I have to disagree with you. There simply was no evidence that the Hildebeast intentionally mishandled any classified materials. While she lied repeatedly about the emails on the campaign trail, there is no indication she lied to the FBI about those emails or to Congress when she was questioned about the Benghazi affair. Being "extremely careless" does not rise up to criminal intent, thus there are no grounds for an indictment.
Those looking for the Hildebeast to be indicted compare the Gen. Petraeus case to Clinton's mishandling of classified materials. That's bogus. Petraeus gave top secret information to his mistress (and biographer), which was a clear violation of the law and to which he admitted in his plea deal.
The system may be rigged as Trump bellows, but it was not not rigged in the case of Clinton's private email server.
Intentionally was not in the statute. The word was just used by Comey. The fix was in.
I must disagree. Several parts of the federal act that cover classified material do not require intent, merely failure to properly control the material. It is kind of like speeding, you don't need to INTEND to speed to be guilty. In any case it doesn't matter, it is a closed deal. It is, I suppose BARELY POSSIBLE there is still something cooking on the Clinton Family Foundation shakedown operation, but without the missing emails and with most of the bad players being foreign government officials the chances of that going anywhere is essentially zero.
