A lawsuit has been launched in the formerly great state of California to stop a ballot initiative that would, if successfully, allow for the splitting of the state into three chunks.
The Planning and Conservation League filed the action, asserting that the proposed change it "too drastic" to be allowed to go thru the normal ballot initiative process. They claim that the legislature must, by 2/3 vote, approve such a proposal or, if that action isn't taken, a state constitutional convention must be used to make the move.
The California Supreme Court has supported this position in the past, stating that initiatives in question actually changed "government structure" which was not what was intended by the California initiative process.
