Ms.
James felonies are pretty straight forward. She took out an FHA loan
on a house in Virginia while claiming it was her principle place of
residence. As a constitutional officer of the state of New York she is
required by law to maintain her principle place of residence in New York
state. She committed fraud at both the state and local level when she
submitted the false paperwork.
She
also submitted a mortgage application for a house in Brooklyn. In that
application she claimed her father was in fact her husband in order to
gt a more favorable mortgage rate. Also a felony at both the federal
and state level.
Conviction of these charges regularly results in prison time. Two years is about par for the course.
Ms.
James is in trouble. She will have a had time claiming an honest
mistake over something she regularly prosecutes people for.New York
MIGHT give her a walk and a New York federal jury might give her a walk,
but I am not sure Virginia would.
The
case was referred to the DOJ by the FHA. I have a hard time believing
that Pam Bondi is going to walk away from this. It is pretty much a
gift. James could lose her law license and the possibility of actual
prison time is not remote at all.
Damn, this will be fun to watch.
