DURIN ICE ARRESTS, LAPD OFFICERS ARE PRESENT SOLELY TO PREVENT INJURY, DE-ESCALATE TENSION, AND PROTECT LIVES

California Cops Just Got a New Playbook for Handling ICE Raids

LOS ANGELES, CA— A new directive issued June 27th from Los Angeles Police Chief Jim McDonnell will require LAPD officers responding to potential federal immigration enforcement actions to automatically request a Supervisor on scene if one is not already present, verify credentials of the supervisor or federal agent in charge if the agents’ can’t be readily identified and capturing said verifications on bodycam footage.

The move comes following a series of ICE operations, misreported or characterized as “kidnappings,” according to LAist, and was the subject of commentary from McDonnell during the Board of Police Commissioners meeting on Tuesday.

The Chief told reporters that officers have been instructed to take “appropriate enforcement action” should they determine that any individuals participating in these actions are not legitimate federal enforcement officers, including detention or arrest for impersonating a peace officer.

However, McDonnell told reporters he can confirm no substantiated incidents of anyone impersonating an ICE agent during an immigration action.

“To my awareness, the officers, when they respond to the scenes, the ones we’ve been there, they’ve determined they are federal enforcement officers,” he said.

Fernando Diaz, 23, was reportedly arrested by Huntington Park Police on Tuesday for allegedly impersonating a federal agent when he requested to retrieve items from his vehicle while it was being impounded.

Police Chief Cosme Lozano told NBC Los Angeles, “Having learned that the vehicle was being impounded, the individual requested to retrieve items from the vehicle that he claimed belonged to a friend,'' Lozano said.

“When questioned by the officers about the police-like items inside the vehicle, the individual claimed he formerly worked as a security guard.''

Officers searched the vehicle and uncovered a loaded 9mm semi-automatic firearm as well as documents displaying the headings of Homeland Security Investigations and U.S. Customs and Border Protection, a document listing U.S. CBP radio codes, and several copies of passports registered under various names.

Under California Law, law enforcement agencies are forbidden from enforcing federal immigration law or cooperating with federal agencies tasked with immigration enforcement, with few exceptions.

McDonnell addressed this on  Tuesday, saying, “We understand that public perception can be sensitive during these operations, some may see our presence as cooperation with federal immigration enforcement. However, our officers are being reminded and are actively communicating on scene that their presence is solely to prevent injury, de-escalate tension, and protect lives.”
