In an interview with the N Y
POST Joe Biden confirmed that he made the decisions about auto pen
signatures for pardons. Sort of. Apparently Joe signed off on a set of
criteria for executive clemency, not for individual named persons, and
intermediaries confirmed whether or not John Smith or Jane Doe MET the
criteria and that intermediary "authorized" the use of the auto pen for a
pardon or commutation.
There is some reasonable doubt about the legal validity of this procedure.
In
response Senator Rand Paul announced today that he was contacting the
DOJ with a criminal referral recommendation against Dr. Anthony Fauci.
Assuming the DOJ accepts the recommendation (which is not a sure thing)
Dr. Fauci will certainly claim his pardon makes him exempt from
prosecution. In that case some federal court authority, ending up in
the Supreme Court, will have to decide on the validity of the pardon
under these particular circumstances.
This one could get very, very interesting indeed.
