Superior Court Judge James
Chalfant made an interesting ruling recently that has effectively
stalled an investigation into allegations of functional gangs within the
deputy ranks of the Los Angeles Sheriff's Office.
The
ruling was in response to a lawsuit filed by the Association For Los
Angeles Deputy Sheriffs, the labor union representing the deputies.
That lawsuit was filed due to an internal investigation being conducted
by the county Inspector General and supported by Sheriff Robert Luna,
who has ordered his deputies to cooperate with the IG.
One
of those things the IG wanted to do was check the deputies for tattoos
and subject them to an in-depth interview regarding possible gang(s)
within the S.O. The lawsuit asserted that these requirements violated
the deputies' rights under the 4th and 5th amendments to the
Constitution, and various parts of state labor law. The judge agreed.
The IG, Max Huntsman, has said he expects the county to appeal the ruling.
