NJ BITCH-SLAPPED IN LEOSA CASE

New Jersey does not have the reputation of being gun friendly.  In fact quite the reverse is true.  They will be significantly effected by the New York Gun Club case just settled by SCOTUS.

Among other things they have been regularly dicking with retired cops who carry weapons under the Law Enforcement Officers Safety Act, a piece of federal law signed during the Bush 43 administration.  New Jersey maintained that the LEOSA did in fact NOT allow qualified retired officers to carry in New Jersey.  New Jersey attempted to enforce this attitude when they wanted to screw with someone.

The state attempted to have the original lawsuit by the Federal Law Enforcement Officers Association and the New Jersey FOP, with amicus briefs filed in support of them by the NRA-ILA and the New Jersey Association of Rifle and Pistol Clubs.  When this happened New Jersey withdraw it's motion to dismiss and changed its LEOSA policy on the state web site.

 However, the federal judge hearing the case said that the non-binding policy change was insufficient to resolve the case.  In the finding the court said  "the court finds that LEOSA preempts the Permit Scheme and prohibition on hollow point ammunition as applied to plaintiffs and QRLEOs who already have identification..."  The court specifically declared that those restrictions were in violation of the Supremacy Clause of the United States Constitution.

The case is captioned as Federal Law Enforcement Officers Association vs. Grewal.
