I admit I could be wrong on the basic premise of this thing. I was under the distinct impression that the German government did NOT have the power of eminent domain. That's what makes this interesting.
The crux of the matter is a home in Austria owned by Gerlinde Pommer. The house is quite ordinary other than the fact it is where Adolph Hitler grew up. The government wants the house. Ms. Pommer does not want to sell. The owner is going to the high court to prevent the government from seizing the property. They have tried to buy it. Ms. Pommer has declined to sell.
The small news blurb I read does not say why the government is so dead-set on taking the house. It seems like the Constitutional Court of Austria is going to make the decision.

FURTHER INFO: The government is preparing a special law that would permit them to seize this property. Her legal action is to prevent this from happening. The government wants to take possession of the house to prevent neo-Nazis from taking it over as a shrine to Hitler.
