Josiah Kenyon: Capitol rioter brags of high IQ before asking for 'right' to FIGHT prison guards

Capitol rioter Josiah Kenyon, accused of assaulting several officers in the attack on January 6, had a heated exchange of words with a federal judge as he asked for permission to defend himself against prison guards at a status hearing for his case in court on Thursday.

According to a report from Politico's Kyle Cheney, the incident began when Josiah Kenyon, 34, asked US District Judge Carl J Nichols for permission to speak during the hearing. Before his comment, Judge Nichols cautioned Kenyon to consult with his attorney before speaking. "I have a high enough IQ range to not screw up there, boss," Kenyon shot back at the judge.

Josiah asked Judge Nichols to "acknowledge that he had a right to defend himself if prison guards in DC tried to assault him," Cheney reported.

Cheney tweeted, “Kenyon said he wanted Judge Nichols to acknowledge that he had a right to defend himself if prison guards in DC tried to assault him. 'I’m not making any finding one way or another about that,' Nichols said. 'Okey-dokey,' Kenyon replied.”

The judge said he would not be "making any finding one way or another" about his right to defend himself while being imprisoned.

The meeting ended when Nichols asked if Kenyon had any other issues to raise. "My wife and children [are] homeless on the street. Have a wonderful day," he replied bluntly to his question.

According to the police, Kenyon assaulted officers with multiple items and threw a "large, hard plastic pylon" at them, and also tried to break a window.

According to court documents, he was in the Capitol for 25 minutes near a Senate Wing door. He then joined a crowd outside at the Lower West Terrace.
Department of Justice alleges that Kenyon wore a Jack Skellington costume, based on a character from the movie 'The Nightmare Before Christmas', to the Capitol. Kenyon got arrested on December 1, 2021, in Reno, Nevada, when Washoe County Sheriff's Office deputies found his wife and his two children in an unheated travel trailer on the foothills of Peavine Mountain.

Attorneys with the Justice Department have charged Kenyon with unlawfully entering the Capitol and assaulting a police officer. Kenyon assaulted several officers with "a table leg with a protruding nail," the FBI said.
