The Mountain-West athletic organization and it's
commissioner, Gloria Nevarez, are on the receiving end of a lawsuit
filed by 12 women "in response to the participation of an alleged
transgender athlete on San Jose State's volleyball team." The complaint
asks for financial damages and an emergency injunction against the
Mountain-West volleyball tournament. The tournament is scheduled for
November 27-30 at UNLV.
The
lawsuit, filed in the U. S. District Court of Colorado, was filed by
SJSU co-captain Brooke Slusser and former (suspended) SJSU assistant
coach Melissa Batie-Smoose as well as at least one player from each of
the four teams who have refused to play against San Jose.
The plaintiffs are alleging, among other things, Title IX violations.
Among
other things the plaintiffs are claiming a plan (conspiracy) to have
Slusser smashed in the face by a spiked volleyball during a game.
Battie-Smoose was suspended after filing a Title IX complaint.
San Jose State has so far declined comment.
