Regular readers will remember I wrote recently about the 
unfortunate death of Marysville P.D. officer Rodarte during a combined 
task force drug operation.  CalOSHA had gotten involved and in fact 
levied fines against both the Marysville P.D. and the Yuba County S.O. 
over what they asserted were deficiencies in how the raid was handled.
Marysville and Yuba County are now both suing CalOSHA.  It is there position that this agency has no jurisdiction in the matter.
The
 first hearing is scheduled for about two weeks from today.  It will be 
very interesting to see what shakes out.  As far as anybody has been 
able to figure out this is the first time that OSHA has inserted 
themselves into this sort of situation since the agency has been 
around.
