The mouthpiece for the murderous illegal alien multiple-felon asshole who was acquitted of murdering Kate Steinle has filed for a new trial on the gun charge he was found guilty of.
His angle is that the illegal alien asshole was only in "momentary possession" of the weapon when it "went off accidentally" while he was handling it, killing Ms. Steinle. The lawyer asserts that this does not constitute "possession" of the weapon on a legal sense and that the judge erred in his instructions to the jury on the matter. He further asserts that the illegal alien asshole sought only to dispose of the weapon and not keep law enforcement from seizing it when he threw it in the bay off the pier.
In the bizrro world of logical inversion that is the People's Republic of San Francisco it is completely possible he will be successful.

It's funny how geography plays such a large role in criminal cases. In Texas he would be a dead man walking.
