This happened in Deerfield, Oneida County, which I think is in upstate New York. At about 0240 hours Ronald Stolarczyk interruped a home invasion / burglary of his residence. He shot both of the intruders, a 57 year old woman and her 27-year old nephew. Both died. The homeowner left in cuffs.
His crime. He inherited the firearm he used from his father to defend himself and never got it registered in his name. He was charged with a class E felony, Criminal Possession of a Firearm.
The intruders were not armed, but were approaching him up the stairs in his home. Under the law there he had no duty to retreat and as a practical matter had no ability to retreat. Also use of deadly force is permitted in those circumstances even if it turns out the intruders are not armed.
The homeowner could get up to four years in prison. He is being held pending $10,000 bond.

This is Bullshit! He would have received a commendation in Texas. I won't even visit New York State or several like minded locations anymore.
