The
left-wing city of San Jose is about to violate both State of California
pre-emption laws and the U. S. Constitution. This effort will
certainly cost them a fair piece of money, but will allow them to
pretend they are morally superior and believe their shit doesn't stink.
Assuming
the proposal actually passes into law the city will require that all
gun owners in the city maintain a liability policy related to use of
their firearms and pay a yearly fee of $25 per gun in order to keep the
guns legally in the city. The idiot mayor, Sam Liccardo, asserts that
the "fee" merely prevents the city from having to "subsidize" folks who
own guns.
Several gun rights organization are already planning to sue if this stupidity passes.
The
insurance policy is supposed to cover "any negligent or accidental use
of the firearm." None of the articles I have read have specified the
amount of this insurance policy. The "fee" (tax) is supposed to go to
various warm-and fuzzy projects. The way it is currently structured is
the gun owners would be required to pay this "fee" to a non-profit set
up specifically for the purpose to handing out the money to appropriate
projects.
I seem to recall
the reason Poll Taxes were dumped is because the Supreme Court said you
can not tax a right. Calling it a "fee" instead of a "tax" does not
change that fact.
Only
one member of the city council, Dev Davis, who is planning to run for
mayor, has not really said she opposes the idea, merely that the cities
time and money could be better spent.
This
notion has been floating around for two years. Tuesday will be the
first actual vote on the proposed ordinance. It will be interesting to
see if the stupid fucks actually vote to pass it. It will then be
interesting to see how long it takes to get an injunction against it,
and how much it will cost the city when they have to eat and pay legal
costs. I will be watching closely and keeping you posted.
