HOMIE DON'T PLAY

Back on January 19th,  two Orange County, CA deputies got in a kerflufle with a suspected shop lifer at WalMart.  

The deputies showed up in response to a call from the WalMart people who reported that the suspects, a man and a woman, seemed about to steal a bunch of stuff.  The deputies approached them and ordered them to leave.  The suspects responded that they were about to buy some stuff.  The deputies replied that the store did not have to sell to them if they didn't want to.  They also responded that the suspects were NOT being arrested but they would be on the receiving end of a no-trespass order and could be arrested if they returned to the store.  The suspects were then escorted out.

As they were being escorted out the male suspect, Ernest Aguilar, returned to the now abandoned shopping cart allegedly to retrieve his cell phone which was maybe in the cart.  One of the deputies walked with him.  As they walked past the checkouts one deputy warned the other that the suspect had a knife.  As the deputy went to cuff Aguilar he started to fight.  The fight went to the ground and somebody yelled HE HAS A GUN.  One deputy attempted to restrain the gun arm.  A second deputy shot Aguilar in the head.

Aguilar survived and is being charged with, among other things, possession of a firearm with an altered serial number and assault on a peace officer.

It was Mr. Aguilar's lucky day. Most head shots are fatal.
