An unnamed woman has sued the SFPD for using the genetic material from her rape kit from 2016 to convict her of a 2021 burglary.
The
women, who filed as Jane Doe, believes that it was somehow unfair of
the PD to use this evidence against her. It should be noted that the
kit was processed by the SFPD crime lab and not by the state lab.
This
sort of evidence from rape kits has been used to match to 17 possible
criminal actions in San Francisco. Jane Doe is the only one who has
actually been prosecuted as a result of these investigations.
The CA legislature has passed a bill to the governor's desk that would make this practice illegal. He has yet to act on it.

It's sort of like saying LPR data is destroyed after one week. It may be destroyed by a user agency by local policy, but I'll wager most is kept by the LPR manufacturer and other husk-hush agencies. People are so naive.
