Regular readers will recall I wrote about a June 19
stabbing at an RTD station in Rancho Cordova (Sac) that left Michael Ray
Berry, 16, death.
Berry
and his female friend were kicked off an RTD vehicle because they were
vaping and would not cease and desist. After they got off the trolley
Berry was involved in a physical fight with the security guard. The
guard stabbed Berry. Berry died.
The
D.A. has just decided to NOT prosecute the case due to insufficient
evidence and an apparently legit case for self-defense. The security
guard was NOT authorized to be carrying a knife and may be facing
unemployment, which is still no doubt better than jail or prison.
In
CA, generally speaking, employers are required to accept court rulings
in things of this nature regarding peace officers. I do not know how
the employer feels about it with regard to non-peace officers.
