REASONABLE AND APPROPRIATE OR PETTY AND PETULANT ?

The Pentagon announced today that United States Senator Mark Kelly (D-Az) may be recalled to active duty and prosecuted under the UCMJ for sedition for the bizarre announcement he and five other members of congress made a couple of days ago encouraging members of the United States military structure to disobey orders from their chain of command.


My own humble opinion, for what that might be worth to you, is that IF it does happen he might have "Command Influence" as a legitimate defense strategy.  That being said I hope they nail his happy ass to the wall.
 
EDITOR'S NOTE. Bob, I'm really disappointed in you. You have either intentionally or unintentionally misrepresented what Kelly said. He told members of the military not to obey illegal orders.
 
Going back to 1946, a whole bunch of Nazi soldiers were tried for committing war crimes.
 
 

The trial, held from May to July 1946 in the former concentration camp at Dachau, Germany, charged German generals along with rank-and-file soldiers. All but one of the defendants was found guilty; within a decade, all walked free.

Some Nazi soldiers were publicly hanged after being convicted of committing war crimes 

 

Their only defense was that they were just obeying orders. Tat didn't work. They were either imprisoned or hanged.

If it ever came to that, the same thing would happen to American soldiers who obeyed an illegal order.
