Governor
Cuomo has indicated that he will sign S7196. This bill, assuming it
does get signed into law, essentially tries to make it impossible for
any member of the "gun industry" to sell pretty much anything in New
York State that could "create, maintain or contribute" to anything that
would "endanger the safety or health of the public" even if that product
were sold legally, if it were eventually used illegally.
The
state is trying to run around of the federal law that says firearms
producers are NOT liable for the illegal use of their products if they
were manufactured and sold in accordance with the law. Assuming this
does make it thru and is upheld anybody that had anything to do with any
dangerous or illegal use of any firearms product could be prosecuted
and held civilly liable. For instance, if you make holsters and you
sell a holster to a cop who uses a gun in a legally inappropriate manner
you could be held liable if he was carrying that gun in one of your
holsters. As could the gun maker. As could the ammo maker. Same would
be true if the firearms related product were stolen from a lawful
owner. The manufacturer(s) could still be held liable.
You
know what would be amusing. If firearms makers, ammo makers and
accessory makers simply quit selling to New York government agencies.
Ain't gonna happen, but it would sure as hell be amusing.
I guess Kimber is now damn glad they got the hell out of New York.
