MAYBE A USEFUL LAW CHANGE IN CALIFORNIA

by Bob Walsh

The People's Republic of California is maybe-probably about to pass a new law that is at least somewhat criminal justice related that I actually think is a good thing.

Current law in CA will pay wrongly convicted felons $140 per day for each day they spent in the slammer, but they have to give clear and convincing proof of ACTUAL INNOCENCE as opposed to just a likely finding of not guilty. That is sometimes hard to do.

IF passed into law SB1094 would extend this payment to persons who were granted a retrial and who the prosecution declined to re-prosecute. It would also cover persons who were granted a retrial and who came back with a not guilty verdict the second time.

The Victim Compensation Board has, within the last 12 yeas, approved 26 payments and denied 50 payments.
