'without delay' and thanks Democrat Harry Reid for 'handing the court to
conservatives' by eliminating the 60 vote senate requirement

President Donald Trump has signaled that he will nominate a replacement
for Supreme Court Justice Ruth Bader Ginsburg 'without delay', setting
up an extraordinary confirmation battle in the Senate just weeks before
the elections.
'We were put in this position of power and importance to
make decisions for the people who so proudly elected us, the most
important of which has long been considered to be the selection of
United States Supreme Court Justices. We have this obligation, without
delay!' Trump tweeted on Saturday morning from the White House.
The
tweet was addressed to the Republican Party's main account, in an
apparent rallying cry to the party to move forward to confirm his
nominee before the November 3 election.
Trump also retweeted a comment
noting that the filibuster for judicial nominees had first been
abolished by former Democratic Majority Leader Harry Reid, eliminating the 60-vote supermajority once needed to confirm
federal justices. 'Thank you Harry!' commented Trump.
In November 2013,
Senate Democrats led by Reid used the so-called 'nuclear option' to
eliminate the 60-vote rule on federal judicial appointments, but not for
the Supreme Court. In 2017, the Republican majority in the Senate
extended the nuclear option to the Supreme Court to confirm Justice Neil
Gorsuch.

President Trump may have the chance to appoint another Justice to the
Supreme Court following the death of RBG on Friday. Trump revealed his
shortlist of 20 names including three sitting senators.
The current
frontrunner is U.S. Circuit Judge Amy Coney Barrett, 48, a devout
Catholic and pro-lifer.
Among the others on the list are
Senator Ted Cruz, Trump's closest competition for
the Republican nomination in 2016; Senator Tom Cotton of Arkansas, who immediately tweeted he would get rid of Roe
v Wade if confirmed; and the Department of Justice official Stephen
Engel, who drafted memo justifying denying cooperation with House
investigations.
Barrett wrote that she agrees 'with those who say that a
justice's duty is to the Constitution, and that it is thus more
legitimate for her to enforce her best understanding of the Constitution
rather than a precedent she thinks clearly in conflict with it'.

Rep. Alexandria Ocasio-Cortez has said that the death of Supreme Court
Justice Ruth Bader-Ginsburg should 'radicalize' Democrats, urging her
supporters to vote for Joe Biden whether they 'like him or not.'
'Let
this moment radicalize you,' Ocasio-Cortez, a New York Democrat, said in
a 40-minute Instagram Live video posted late on Friday, which was
viewed by more than 1.5 million people within 12 hours.
'Let this moment
really put everything into stark focus, because this election has
always been about the fight of and for our lives. And if anything,
tonight is making that more clear to more people than ever before,' she
continued. 'It's earth-shattering, this kind of vacancy,' she said of
the spot now open on the nation's highest court, which opens a path for
President Donald Trump to nominate a replacement for the liberal justice
with the presidential election just weeks away.
Ocasio-Cortez, the
freshman leader of the so-called 'Squad' of progressive House Democrats,
said that Ginsburg's death represented a 'tipping point' and urged her
followers to action, saying 'I need you to be ready.' 'No president is
the answer,' she said. 'You are the answer. Mass movements are the
answer.'

It is possible the Senate may be collegial enough to vote Cruz an OK with less difficulty than someone else. With the current political climate, I am not sure I would bet on that.
