The US Supreme Court has ruled in favor of a cheerleader who was kicked
off her squad for posting 'fuck cheer' on Snapchat, saying the high
school violated her freedom of speech.
The court sided with Pennsylvania
teen Brandi Levy, then 14, in a landmark ruling Wednesday that extends
the protection of free speech among school students to social media.
Levy, now 18, was suspended from her cheerleading squad by the Mahanoy
Area School District in 2017 for posting 'fuck school, fuck cheer' on
her Snapchat on a weekend.
The sophomore later successfully sued the
school district over the decision by arguing that she should not have
been punished for speech that occurred outside of school hours. But the
school district decided to take the case to Supreme Court, arguing that
the lower court's ruling prevented them from taking action against
speech that 'disrupts the school environment'.
The case drew national
attention as it questioned whether a landmark 1969 ruling, which found
that schools were permitted to regulate on-campus student speech when it
is disruptive to the school environment, also applies to speech made
off-campus and on social media.
On Wednesday, justices in a 8-1 ruling, once again sided with the teen
and decided that the school's punishment violated her free speech
rights.
