Derek
Victor Oakes is a Captain with Sacramento Metro Fire. About two years
ago the feds raided his home looking for "illegal machine gun parts."
What they found fits the bill, in their opinion.
The
found part of an Uzi submachine gun. I have no idea what part. They
found a fair number of "high capacity" (actually standard factory
capacity) magazines. They found 19 "assault rifles" and parts for
others. They also found a couple of Glock auto sears.
He
is being prosecuted on state charges rather than federal charges and
will loose his job if convicted. His basic defense up to this point is
that he had no idea the "stuff" he had presented any legal problem. He
has no prior legal problems of any sort.
The
El Dorado County D A is considering letting Oakes cop to misdemeanor
charges so he can keep his job. His lawyer is asserting that the Glock
aftermarket auto sears were in fact perfectly legal to purchase (though
not install) at the time he bought them. There is no evidence the parts
were ever actually installed in a firearm.
