ILLEGAL POSSESSION BUT STILL A GOOD SHOOT

A Georgia judge has dismissed a murder charge against a teen after concluding that he was legally justified in shooting a man seven times in 2021 because the man was trying to kidnap him. 
 
An interesting case out of Georgia has determined that an illegal possession of a firearm does not necessarily mean the use of that firearm is unlawful.

The object of the exercise has not been named as he was 17 at the time of the incident.  He was at a public park with a loaded handgun in his backpack.  At some point an armed adult, 22 years old, came up to him, beat on him with a handgun a little bit, order the teen to come with him or he would shoot him, and then put his gun in his waistband.  At that time the teen grabbed his own gat and shot the man who was attempting to kidnap him seven times.

The prosecutor in Muscogee County asked the judge to dismiss the charges in the case stemming from the 2021 incident. The prosecutor concluded, based on witnesses and video footage, that the teen was the victim of an attempted kidnapping and under Georgia law had the right to defend himself.

The mother of the dead guy objects because her son had put his gun away and was shot in the back, including a few times while he was down.  Too bad.  So sad.
