Benitez does not have his head up his ass and is a more-or-less strict
construction kind of guy when it comes to his job. Newsom much prefers
the living-breathing document characterization of the constitution,
because if it is living you can kill it.
SB1327,
signed into law by the governor of the formerly great state of
California, allowed members of the general public to sue gun
manufacturers despite federal protection laws. The specific provision
blocked would have required the plaintiffs that sue to challenge the law
must pay costs to the state for defending the (clearly
unconstitutional) law.
In
Benitez's opening sentence his ruling asserted, "It is cynical. It is
an abomination. It is outrageous and objectionable. There is no
dispute that it raises serious constitutional questions. It is an
unprecedented attempt to thwart judicial review. Today it applies to
the Second Amendment. Tomorrow...it could be any other constitutional
right..."
Newsom and the Judge don't like each other much.
