FATAL DOG ATTACK RESULTS IN LAWSUIT AND CRIMINAL CHARGES

Back in March in New Hope, Alabama, two-year old Mark Allen Partain was mauled to death by one or more dogs in the home of Melissa and Jeffrey Phillips.  Both of the dog owners are now facing a civil suit as well as criminal action in the death.

The child was at the Phillips home at the time of the attack.  It isn't completely clear why the parents, Jason and Kyala Partain, allowed their child to be there as they knew the dogs were on the property and allowed to roam.

The three dogs were seized after the incident.  A husky is believed to have been the sole or principle culprit.  All three dogs have been put down.

A six year old Alabama law holds the owners of a dog strictly liable for such incidents if the dogs knew or reasonably should have known that the dog was dangerous, or if the dog had previously been designated as a dangerous dog due to problem activity.  Death by dangerous dog is a specific criminal offense in Alabama.  Both of the dog owners have now been arrested and charged.
