Jereh Lubrin, Matthew Farris and Rafael Rodriguez were convicted of second-degree murder back in 2017 for the in-custody death of Michael Tyree in 2017. They allegedly beat him to death in a PC cell in the jail. They were sentenced to 15-life.
On Monday the Fourth District appeals division kicked them loose. In 2018 the CA legislature passed AB1437, which invalidated the "natural and probably consequences" theory, sometimes known as the Felony Murder Rule. The new law is retroactive.
The county has not yet determined whether or not they will retry the former deputies under the new guidelines.
