The Oregon Supreme Court has refused to intervene in the
matter of Measure 114, which for practical purposes would, over the
short term, ban all firearms sales in the state and would ban the new
sale of any firearms magazine that held more than 10 rounds of ammo.
The
measure was put on hold by a Harney County Judge. A federal judge,
Karin Immergut, stalled implementation for 30 days at the state's
request due to the inability of the state to get the now mandatory
permit to buy program in place. Her order allowed the magazine ban to
go into effect. The Harney County order did not.
This
new action, or possibly rather a studied inaction, means that the lower
court judicial order remains in place until acted upon by a higher
court. The Oregon DOJ asked for the ruling and I suspect were more than
a little pissed when they didn't get the ruling they wanted. The one
page order came down late on Wednesday signed by the Chief Justice,
Martha Walters. It gave no reasoning behind the decision, nor is it
required to.
