SCOTUS
decided to NOT rule on a case on whether or not women should be forced
to register for the draft. The court pointed out that traditionally the
court has not messed with military and defense matters if they could be
avoided and further than congress is actively looking at the Selective
Service Act.
The question
is whether or not requiring men to register but not placing the same
burden on women is an equal protection issue. The ACLU urged the court
to take up the issue, asserting that the requirement makes women
second-class citizens, claiming that it makes women appear to be less
fit than men to serve their country and men less fit than women to stay
home and be caregivers.
The National Coalition For Men and two unnamed individuals brought the action.
