ARMED ROBBERS NOW HAVE THE RIGHT OF SELF DEFENSE IN CONTRA COSTA COUNTY, CA.

Last Saturday a robbery occurred at a gas station in Antioch, CA.  The clerk, James Williams, 36, pursued the two robbers out of the store.  Williams was armed, as was at least one of the robbers.  Williams opened fire on the bad guys, hitting Ronald Jackson, 20, in the leg.  Jackson returned fire, killing Williams.  Robber #2 got away.

 The D.A. is NOT charging Jackson with murder. He is being charged with robbery and a firearm enhancement.  Apparently now in Contra Costa County armed robbers have the right to defend themselves from their victims.

Under the old law anybody who was actively involved in a criminal act from which death might reasonably occur (such as an armed robbery) could be charged with murder if such death did in fact occur. Under the current law only the actual shooter can be charged, assuming the actual shooter can be identified.
